These Terms and Conditions (“Terms”) govern your access to and use of the ScopeWorks Inspector mobile application (“App”) and related services (“Services”).
The App is operated by ScopeWorks ScopeWorks [ SCOPE WORKS NEW ZEALAND LIMITED ] , New Zealand (“ScopeWorks”, “we”, “us”, or “our”).
By accessing or using the App, you agree to these Terms. If you do not agree with these Terms, you must not use the App.
ScopeWorks Inspector is a professional field inspection and reporting application designed for authorised ScopeWorks personnel.
The App may be used to:
The App is not intended to be a general consumer property inspection application.
Access to the App is restricted to users authorised by ScopeWorks.

ScopeWorks may suspend or terminate access where it reasonably believes that an account has been misused, compromised or used contrary to these Terms.
You are responsible for maintaining the confidentiality of your login credentials.

Inspectors using the App are responsible for ensuring that information entered into an inspection record is accurate and complete to the best of their professional knowledge.

The App is a tool for recording and managing inspection information. It does not replace professional judgement.
The App may provide workflows for recording information relevant to New Zealand Healthy Homes requirements, including:
The App does not itself provide legal certification or guarantee that a property complies with the Healthy Homes Standards.
Inspectors must apply their professional judgement and ScopeWorks’ approved inspection methodology.
The property owner, landlord or other responsible party remains responsible for meeting applicable legal obligations.
Where a formal compliance statement or other statutory document is required, that document must be completed and signed by the appropriate person in accordance with applicable New Zealand requirements.
The ScopeWorks Inspector App includes functionality for inspectors to record information relating to Smoke Alarm inspections.
Smoke Alarm inspection information may include:
Smoke Alarm inspections are maintained as a separate inspection category within the App.
Smoke alarms are not represented by ScopeWorks as one of the five Healthy Homes Standards. The App may nevertheless include Smoke Alarm checks because smoke alarm requirements are relevant to rental-property inspections in New Zealand.
Inspectors must assess and record smoke alarm information in accordance with:
The App is a recording and reporting tool and does not itself certify that a property complies with New Zealand smoke alarm requirements.
Where a smoke alarm is identified as missing, defective, incorrectly positioned, expired or otherwise requiring attention, the inspector should record the relevant observation and evidence in accordance with ScopeWorks’ inspection procedures.
The property owner, landlord or other legally responsible party remains responsible for meeting applicable legal obligations relating to smoke alarms.
The App may be used to record information relating to Meth Testing inspections and samples.
Information recorded in the App does not, by itself, constitute a laboratory result unless specifically identified as such.
Where laboratory analysis is required, results must be obtained from the applicable testing or laboratory provider.
Inspectors must follow ScopeWorks’ procedures for:
The App does not independently determine whether a property is contaminated or safe unless a specific validated ScopeWorks workflow expressly provides such functionality.
You are responsible for reviewing information before submitting an inspection.
Inspection records may include:
Once submitted, an inspection record may become part of ScopeWorks’ business records and may be subject to access restrictions or amendment procedures.
Photographs must be taken only for legitimate inspection purposes.
You must take reasonable steps to avoid unnecessarily capturing:
You must not use photographs captured through the App for personal, commercial or unrelated purposes.
Inspection photographs may become part of the customer’s inspection record and may be included in reports.
Where enabled, the App may use device location services to support inspection operations.
Location information may be used to:
You must not manipulate, falsify or interfere with location information used by the App.
The App may support offline inspection functionality.
When offline, information may be stored temporarily on the device and synchronised when an internet connection becomes available.
You are responsible for keeping your device secure while inspection information is stored locally.
You should not uninstall the App, clear its data or otherwise interfere with local storage while unsynchronised inspection information remains on the device.
ScopeWorks cannot guarantee that information will be recoverable if a device is lost, damaged, reset or otherwise compromised before synchronisation.
The App may generate reports based on information entered by inspectors and information stored within ScopeWorks systems.
Reports should be reviewed for accuracy before being issued where ScopeWorks’ procedures require such review.
ScopeWorks may correct, amend, replace or withdraw a report where an error, omission or other issue is identified.
A generated report does not override applicable legislation, regulations, contractual obligations or professional requirements.
You must use customer and property information only for authorised ScopeWorks business purposes.
You must not:
Unauthorised disclosure may result in disciplinary action, termination of access or other appropriate action.
The App may integrate with third-party services, including services used for:
Third-party services may have their own terms and privacy policies.
ScopeWorks is not responsible for third-party services that are outside its reasonable control.
The App, including its software, interface, design, branding, documentation and underlying technology, is owned by or licensed to ScopeWorks or its technology providers.
Except where permitted by law or expressly authorised by ScopeWorks, you must not:
ScopeWorks retains all rights not expressly granted under these Terms.
Inspection data submitted through the App remains subject to ScopeWorks’ business and record-keeping requirements.
ScopeWorks may use inspection information for legitimate purposes including:
Personal information will be handled in accordance with ScopeWorks’ Privacy Policy.
The App is a recording and workflow tool.
ScopeWorks does not represent that automatically generated calculations, reminders, classifications, suggestions or other software outputs will always be error-free.
Inspectors must independently verify information where professional judgement is required.
Where there is a conflict between an App-generated result and applicable legislation, professional standards, laboratory results or ScopeWorks’ approved methodology, the applicable authoritative requirement takes precedence.
You must not use the App to:

The App may occasionally be unavailable because of:
ScopeWorks may release updates, patches, improvements and security fixes.
You may be required to install an updated version of the App to continue using certain features.

Upon termination, you must stop using the App and must not attempt to regain access without authorisation.
To the extent permitted by law, the App is provided as a business software tool and is not a substitute for professional judgement, applicable legislation, official government guidance, laboratory analysis or other required professional services.
ScopeWorks does not guarantee that:
To the maximum extent permitted by applicable New Zealand law, ScopeWorks will not be liable for indirect, incidental, consequential or special loss arising from use of the App, including loss resulting from:
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under New Zealand law.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under the Consumer Guarantees Act 1993 or other applicable New Zealand legislation.
Where the App is supplied for business purposes and the parties have lawfully agreed to contract out of applicable provisions of the Consumer Guarantees Act, that agreement will apply only to the extent legally permitted.
Your use of the App is also governed by the ScopeWorks Inspector Privacy Policy.
The Privacy Policy explains how ScopeWorks collects, uses, stores, protects and discloses personal information.
The Privacy Policy should be read together with these Terms.
These Terms are governed by the laws of New Zealand.
Any dispute concerning these Terms or use of the App will be subject to the applicable jurisdiction of the courts of New Zealand, unless otherwise required by law.
ScopeWorks may update these Terms from time to time.
Updated Terms will be made available through the App or an appropriate ScopeWorks website.
Where a material change requires additional notice or consent, ScopeWorks will provide that notice or obtain consent as required.
