These Terms and Conditions (“Terms”) govern your access to and use of the ScopeWorks Inspector mobile application (“App”) and related services (“Services”).

The App is operated by ScopeWorks ScopeWorks [ SCOPE WORKS NEW ZEALAND LIMITED ] , New Zealand (“ScopeWorks”, “we”, “us”, or “our”).

By accessing or using the App, you agree to these Terms. If you do not agree with these Terms, you must not use the App.

1. Purpose of the App

ScopeWorks Inspector is a professional field inspection and reporting application designed for authorised ScopeWorks personnel.

The App may be used to:

  • Manage assigned property inspections
  • Conduct Healthy Homes inspections
  • Conduct Smoke Alarm inspections
  • Conduct or record Meth Testing inspections
  • Record property information
  • Capture photographs and other evidence
  • Record measurements and observations
  • Document findings and recommendations
  • Submit inspection information
  • Generate inspection reports
  • Maintain inspection records

The App is not intended to be a general consumer property inspection application.

2. Authorised Users

Access to the App is restricted to users authorised by ScopeWorks.

You must:

  • Use only your own authorised account
  • Provide accurate information
  • Keep your login credentials confidential
  • Keep your device reasonably secure
  • Not allow another person to use your account
  • Not share passwords or authentication codes
  • Immediately notify ScopeWorks if you suspect unauthorised access

ScopeWorks may suspend or terminate access where it reasonably believes that an account has been misused, compromised or used contrary to these Terms.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You must not:

  • Share your password
  • Circumvent authentication controls
  • Attempt to access another user’s account
  • Attempt to gain unauthorised access to ScopeWorks systems
  • Use another inspector’s credentials
  • Disable or interfere with security controls

4. Inspector Responsibilities

Inspectors using the App are responsible for ensuring that information entered into an inspection record is accurate and complete to the best of their professional knowledge.

You should:

  • Follow ScopeWorks’ inspection procedures
  • Follow applicable laws and regulations
  • Follow relevant professional standards
  • Enter accurate observations and measurements
  • Attach appropriate evidence
  • Take reasonable care when photographing properties
  • Verify information before submitting an inspection
  • Report errors promptly
  • Protect customer and property information

The App is a tool for recording and managing inspection information. It does not replace professional judgement.

5. Healthy Homes Inspections

The App may provide workflows for recording information relevant to New Zealand Healthy Homes requirements, including:

  • Heating
  • Insulation
  • Ventilation
  • Moisture ingress and drainage
  • Draught stopping

The App does not itself provide legal certification or guarantee that a property complies with the Healthy Homes Standards.

Inspectors must apply their professional judgement and ScopeWorks’ approved inspection methodology.

The property owner, landlord or other responsible party remains responsible for meeting applicable legal obligations.

Where a formal compliance statement or other statutory document is required, that document must be completed and signed by the appropriate person in accordance with applicable New Zealand requirements.

6. Smoke Alarm Inspections

The ScopeWorks Inspector App includes functionality for inspectors to record information relating to Smoke Alarm inspections.

Smoke Alarm inspection information may include:

  • Number of smoke alarms
  • Location of each smoke alarm
  • Type of smoke alarm
  • Alarm condition
  • Whether the alarm is operational
  • Test result
  • Battery information, where applicable
  • Installation location
  • Positioning information
  • Expiry or replacement information, where applicable
  • Photographs
  • Inspector observations
  • Recommendations
  • Remedial actions

Smoke Alarm inspections are maintained as a separate inspection category within the App.

Smoke alarms are not represented by ScopeWorks as one of the five Healthy Homes Standards. The App may nevertheless include Smoke Alarm checks because smoke alarm requirements are relevant to rental-property inspections in New Zealand.

Inspectors must assess and record smoke alarm information in accordance with:

  • ScopeWorks’ inspection procedures
  • Applicable New Zealand legislation and requirements
  • Relevant professional guidance
  • The information available at the property at the time of inspection

The App is a recording and reporting tool and does not itself certify that a property complies with New Zealand smoke alarm requirements.

Where a smoke alarm is identified as missing, defective, incorrectly positioned, expired or otherwise requiring attention, the inspector should record the relevant observation and evidence in accordance with ScopeWorks’ inspection procedures.

The property owner, landlord or other legally responsible party remains responsible for meeting applicable legal obligations relating to smoke alarms.

7. Meth Testing

The App may be used to record information relating to Meth Testing inspections and samples.

Information recorded in the App does not, by itself, constitute a laboratory result unless specifically identified as such.

Where laboratory analysis is required, results must be obtained from the applicable testing or laboratory provider.

Inspectors must follow ScopeWorks’ procedures for:

  • Sample collection
  • Sample identification
  • Sample handling
  • Chain of custody
  • Laboratory submission
  • Recording results
  • Reporting findings

The App does not independently determine whether a property is contaminated or safe unless a specific validated ScopeWorks workflow expressly provides such functionality.

8. Inspection Information

You are responsible for reviewing information before submitting an inspection.

Inspection records may include:

  • Property details
  • Customer information
  • Photographs
  • Measurements
  • Findings
  • Notes
  • Recommendations
  • Smoke Alarm information
  • Healthy Homes information
  • Meth Testing information
  • Sample information
  • Signatures or acknowledgements
  • Date and time information
  • Location information where enabled

Once submitted, an inspection record may become part of ScopeWorks’ business records and may be subject to access restrictions or amendment procedures.

9. Photographs and Evidence

Photographs must be taken only for legitimate inspection purposes.

You must take reasonable steps to avoid unnecessarily capturing:

  • People
  • Personal documents
  • Identification documents
  • Financial information
  • Passwords
  • Private correspondence
  • Other unrelated personal information

You must not use photographs captured through the App for personal, commercial or unrelated purposes.

Inspection photographs may become part of the customer’s inspection record and may be included in reports.

10. Location Services

Where enabled, the App may use device location services to support inspection operations.

Location information may be used to:

  • Confirm inspection attendance
  • Associate an inspection with a property
  • Support inspection records
  • Detect potential operational issues
  • Improve security

You must not manipulate, falsify or interfere with location information used by the App.

11. Offline Use

The App may support offline inspection functionality.

When offline, information may be stored temporarily on the device and synchronised when an internet connection becomes available.

You are responsible for keeping your device secure while inspection information is stored locally.

You should not uninstall the App, clear its data or otherwise interfere with local storage while unsynchronised inspection information remains on the device.

ScopeWorks cannot guarantee that information will be recoverable if a device is lost, damaged, reset or otherwise compromised before synchronisation.

12. Inspection Reports

The App may generate reports based on information entered by inspectors and information stored within ScopeWorks systems.

Reports should be reviewed for accuracy before being issued where ScopeWorks’ procedures require such review.

ScopeWorks may correct, amend, replace or withdraw a report where an error, omission or other issue is identified.

A generated report does not override applicable legislation, regulations, contractual obligations or professional requirements.

13. Customer and Property Information

You must use customer and property information only for authorised ScopeWorks business purposes.

You must not:

  • Copy customer information for personal use
  • Export information without authorisation
  • Share inspection information with unauthorised persons
  • Use customer information for personal marketing
  • Contact customers for unrelated purposes
  • Store inspection information in unauthorised systems

Unauthorised disclosure may result in disciplinary action, termination of access or other appropriate action.

14. Third-Party Services

The App may integrate with third-party services, including services used for:

  • Cloud hosting
  • Data storage
  • Authentication
  • Notifications
  • Email
  • Error monitoring
  • Analytics
  • Laboratory or testing services
  • Report generation

Third-party services may have their own terms and privacy policies.

ScopeWorks is not responsible for third-party services that are outside its reasonable control.

15. Intellectual Property

The App, including its software, interface, design, branding, documentation and underlying technology, is owned by or licensed to ScopeWorks or its technology providers.

Except where permitted by law or expressly authorised by ScopeWorks, you must not:

  • Copy the App
  • Modify the App
  • Reverse engineer the App
  • Decompile the App
  • Extract source code
  • Create derivative works
  • Remove copyright or proprietary notices
  • Resell or sublicense the App
  • Use the App to develop a competing product

ScopeWorks retains all rights not expressly granted under these Terms.

16. Inspection Data

Inspection data submitted through the App remains subject to ScopeWorks’ business and record-keeping requirements.

ScopeWorks may use inspection information for legitimate purposes including:

  • Providing inspection services
  • Preparing reports
  • Quality assurance
  • Auditing
  • Customer support
  • Training and process improvement
  • Legal and regulatory compliance
  • Dispute resolution
  • Maintaining business records

Personal information will be handled in accordance with ScopeWorks’ Privacy Policy.

17. Accuracy and Professional Judgement

The App is a recording and workflow tool.

ScopeWorks does not represent that automatically generated calculations, reminders, classifications, suggestions or other software outputs will always be error-free.

Inspectors must independently verify information where professional judgement is required.

Where there is a conflict between an App-generated result and applicable legislation, professional standards, laboratory results or ScopeWorks’ approved methodology, the applicable authoritative requirement takes precedence.

18. Prohibited Activities

You must not use the App to:

  • Conduct unauthorised inspections
  • Submit false inspection information
  • Falsify measurements
  • Manipulate photographs or evidence for deceptive purposes
  • Falsify inspection dates or locations
  • Submit another person’s work as your own
  • Access unauthorised information
  • Interfere with the App or its infrastructure
  • Introduce malware or malicious code
  • Attempt to bypass security
  • Scrape or extract data without authorisation
  • Use the App for unlawful purposes
  • Violate another person’s privacy
  • Use the App for personal commercial activities without authorisation

19. Availability

We aim to keep the App and Services available and reliable but do not guarantee uninterrupted availability.

The App may occasionally be unavailable because of:

  • Maintenance
  • Updates
  • Technical problems
  • Internet or telecommunications failures
  • Cloud service outages
  • Security incidents
  • Events beyond our reasonable control

20. Updates

ScopeWorks may release updates, patches, improvements and security fixes.

You may be required to install an updated version of the App to continue using certain features.

Updates may:

  • Add features
  • Remove features
  • Change workflows
  • Improve security
  • Change technical requirements
  • Correct errors

21. Suspension and Termination

ScopeWorks may suspend or terminate access to the App where:

  • Your employment or engagement with ScopeWorks ends
  • You are no longer authorised to use the App
  • You breach these Terms
  • Your account presents a security risk
  • You misuse customer or property information
  • You provide false information
  • Required by law
  • The App or Services are discontinued

Upon termination, you must stop using the App and must not attempt to regain access without authorisation.

22. Disclaimer

To the extent permitted by law, the App is provided as a business software tool and is not a substitute for professional judgement, applicable legislation, official government guidance, laboratory analysis or other required professional services.

ScopeWorks does not guarantee that:

  • The App will always be available
  • The App will always be error-free
  • Every calculation or automated output will be accurate
  • Every inspection record will be complete
  • The App will identify every property issue
  • An inspection report will by itself establish legal compliance
  • A Smoke Alarm inspection recorded in the App constitutes legal certification
  • A Healthy Homes inspection recorded in the App constitutes a formal compliance statement
  • A Meth Testing record constitutes a laboratory result unless specifically identified as such

23. Limitation of Liability

To the maximum extent permitted by applicable New Zealand law, ScopeWorks will not be liable for indirect, incidental, consequential or special loss arising from use of the App, including loss resulting from:

  • Network failures
  • Device failures
  • Loss of unsynchronised offline data
  • Unauthorised access resulting from failure to secure a device or account
  • Incorrect information entered by a user
  • Failure to follow inspection procedures
  • Third-party service interruptions

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under New Zealand law.

24. Consumer Guarantees Act

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under the Consumer Guarantees Act 1993 or other applicable New Zealand legislation.

Where the App is supplied for business purposes and the parties have lawfully agreed to contract out of applicable provisions of the Consumer Guarantees Act, that agreement will apply only to the extent legally permitted.

25. Privacy

Your use of the App is also governed by the ScopeWorks Inspector Privacy Policy.

The Privacy Policy explains how ScopeWorks collects, uses, stores, protects and discloses personal information.

The Privacy Policy should be read together with these Terms.

26. New Zealand Law

These Terms are governed by the laws of New Zealand.

Any dispute concerning these Terms or use of the App will be subject to the applicable jurisdiction of the courts of New Zealand, unless otherwise required by law.

27. Changes to These Terms

ScopeWorks may update these Terms from time to time.

Updated Terms will be made available through the App or an appropriate ScopeWorks website.

Where a material change requires additional notice or consent, ScopeWorks will provide that notice or obtain consent as required.
